Terms of Service

Welcome to the Hushabye App (the “App”), operated by Hushabye Nursery (“we,” “our,” or “us”). By downloading or using the App, you agree to these Terms of Service.

1. Use of the App

The App is provided for informational purposes only. You agree to use the App in compliance with all applicable laws and not to misuse or interfere with its normal operation.

2. User Accounts

Certain features, including client course materials and calendar content, require an account. Accounts are limited to Hushabye clients who have a valid invite code. You are responsible for providing accurate information, keeping your login credentials confidential, and all activity under your account.

You may request deletion of your account in the App, or request deletion by email. After you request deletion, we retain your account and associated data for 30 days. If you sign in during that period, deletion is canceled and your account is restored. After 30 days, the account and associated data are permanently deleted. Details are in our Privacy Policy.

We may suspend or terminate an account that violates these Terms or that we reasonably believe is unauthorized.

3. Content and Functionality

The App displays publicly available calendar data using read-only iCalendar (ICS) links. While we strive for accuracy, we do not guarantee that content is complete, accurate, or up-to-date.

4. Content and Educational Materials

The App may include educational materials, including documents and PDF resources, provided for informational purposes only. These materials are not intended to serve as professional, medical, or legal advice.

While we strive to provide accurate and up-to-date information, we make no guarantees regarding the completeness, reliability, or accuracy of any content provided within the App.

All content, including PDF materials, is the property of Hushabye Nursery or its licensors and is protected by applicable intellectual property laws. You may access and use this content for personal, non-commercial purposes only. You may not reproduce, distribute, or modify this content without prior written permission.

5. Privacy

We collect and store account information and related data as described in our Privacy Policy. By using the App, you acknowledge that policy.

6. Third-Party Services

The App may rely on third-party technologies to function, including hosting and authentication services. We are not responsible for the performance or availability of these services. Your use of those services may also be subject to their own terms and privacy policies.

7. Apple App Store Additional Terms

If you access or download the App from the Apple App Store, you agree to the following additional terms:

• These Terms are an agreement between you and Hushabye Nursery, not with Apple Inc.
• Apple Inc. is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support services for the App.
• In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
• Apple is not responsible for addressing any claims relating to the App, including but not limited to product liability claims, legal compliance claims, or consumer protection claims.
• In the event of any third-party claim that the App infringes intellectual property rights, Hushabye Nursery, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
• You agree to comply with all applicable third-party terms of agreement when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent permitted by law, Hushabye Nursery shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

10. Indemnification

You agree to indemnify and hold harmless Hushabye Nursery and its affiliates from and against any claims, damages, liabilities, and expenses arising out of your use of the App or violation of these Terms.

11. Changes to the Terms

We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.

12. Termination

We reserve the right to terminate or suspend access to the App at any time without notice for any reason.

13. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.
